Strong child custody agreement can mean a successful divorce

Divorce can be difficult, and when children are involved, it can be significantly more complicated. Child custody issues in Texas and elsewhere must be resolved carefully and should always keep the best interest of the child in mind. When formulating child custody plans, it is important to understand the different legal terms that one may encounter.

There are two terms that are typically associated with child custody. Those are legal custody and physical custody. Legal custody pertains to who has the responsibility for making decisions regarding the child for issues such as health care, religion, education and general wellbeing. Physical custody pertains to where and with whom the child resides and how parenting time and location are divided between the parents.

It is generally understood that a relationship with both parents is in the best interest of the child. With this in mind, joint legal custody could best serve the interests of the child, providing that both parents can come to an agreement on any issues that may arise. Physical custody may be determined by multiple factors such as a parent's time constraints and geographical location in relation to schools, friends and so on.

Resolving child custody issues in a divorce in Texas can be one of the most difficult tasks a parent may ever undertake. While the court can get involved if parents are unable to reach an agreement, it is far better for all involved if the parents can come to an agreement together that meets the best interest of the child.
